Today, President Biden issued a new Executive Order on Protecting Worker Health and Safety from COVID-19, which can be found here: https://www.whitehouse.gov/briefing-room/presidential-actions/2021/01/21/executive-order-protecting-worker-health-and-safety/.

Essentially, this Executive Order requires OSHA to:

  • Issue revised guidance to employers on workplace safety during the COVID-19 pandemic within the next two weeks.
  • Consider whether any emergency temporary standards on COVID-19 are needed and issue by March 15, 2021, if necessary.
  • Review enforcement efforts and those that put a large number of workers at serious risk.
  • Ensure workers in OSHA state-plan states are protected from COVID-19, consistent with new guidance or standard issued by OSHA.

We are currently in the process of working with the CISC to draft a letter to OSHA that will touch on efforts the construction industry has taken since the beginning of the pandemic to keep workers safe and requesting a stakeholder meeting with the appropriate OSHA staff to open up a dialogue on this issue.
